The Supreme Court has overturned the contempt conviction and arrest warrant issued against Ernest Yaw Kumi, the New Patriotic Party (NPP) Member of Parliament for Akwatia.
In a 4–1 majority ruling delivered on Wednesday, the apex court nullified the Koforidua High Court’s February 2025 decision, which had found Kumi guilty of contempt and ordered his arrest for allegedly defying an injunction on his swearing-in.
Justice Emmanuel Senyo Amadehe had issued the bench warrant after ruling that Kumi breached an interim order linked to a disputed parliamentary election petition.
But the Supreme Court, led by Justice Gabriel Pwamang (dissenting) and supported by Justices Mensa-Bonsu, Gaewu, Kwofi and Frimpong, held that the High Court lacked jurisdiction because the Electoral Commission had not gazetted the election results at the time the petition was filed.
Kumi’s legal team, led by Gary Nimako Marfo, also argued the judge showed bias and denied natural justice by proceeding with the contempt hearing while a challenge to the court’s jurisdiction was pending.
The Supreme Court’s ruling prohibits the High Court from sentencing Kumi and invalidates all prior rulings and injunctions tied to the contested petition.
