CAS throws out Osei Palmer’s case against GFA

Kurt Okraku will stay on as president of the Ghana Football Association after Osei Kwaku Palmer’s appeal to annul last year’s GFA elections was dismissed

The Court of Arbitration for Sports (CAS) has thrown out an appeal by Wilfred Osei Kwaku Palmer against the Ghana Football Association (GFA).

The president of Tema Youth FC dragged the GFA to the tribunal claiming he was unfairly disqualified from the GFA’s presidential elections last October.

He prayed the court to annul the GFA elections, which saw Kurt Okraku beat five others to be elected as president.

A discontented Osei Palmer turned to CAS to seek redress after his appeal at the national level was dismissed.

CAS upholds committee ruling 

The ruling by the Swiss court was initially expected to be out on 17 July 2020 but was postponed twice.

Tuesday’s verdict from CAS, signed by President of the Panel Michele Bernasconi, upheld Palmer’s disqualification by the now-defunct Normalisation Committee/Elections Committee.

“The appeal filed on 14 October 2019 by Wilfred Kwaku Osei against the Ghana Football Association (GFA) with respect to the decision rendered on 4 October 2019, respectively 8 October 2019 by the elections committee of the respondent is dismissed,” the ruling from CAS said.

“The decision rendered on 4 October 2019, respectively 8th October 2019 by the GFA elections committee of the respondent are confirmed.

“The costs of the arbitration, to be determined and served to the parties by CAS court office, and shall be borne by Wilfred Kwaku Osei. Each party shall bear its own costs in connection with the arbitration proceedings. All other or further claims are dismissed,” it said.

 Victory for Ghana football

Osei Palmer was disqualified from last October’s FA elections for failing to pay a 10% mandatory fee to the association for the transfer of his player, Joseph Painstil, to the Belgian club KRC Genk.

The other reason for his disqualification was given as his inability to prove he apologised to the Ethics Committee after seemingly endorsing bribery of referees during a radio interview.

However, Palmer said he accepts CAS’s ruling, describing it as a victory for Ghana football.

“I am gratified by the fact that this long legal tussle has finally come to an end,” a statement signed by him said.

“Even though I have issues against the main grounds for the delivery of the final verdict, I have no other alternative than to accept it in good faith and move on in life. At the end of the day, it is a victory for Ghana football.”
