#OccupyJubileeHouse: Filing an injunction is enough to halt a protest, says lawyer
The police have arrested 49 suspects in connection with the planned demonstration at the vicinity of the Jubilee House – the seat of government – on Thursday
A private legal practitioner Alex K K Abban has said the process of filing an injunction alone by one party is enough to halt a protest by an aggrieved party without a full hearing in court.
The police have arrested 49 suspects in connection with the planned demonstration at the vicinity of the Jubilee House – the seat of government – on Thursday (21 September).
They were arrested “within the vicinity of the Jubilee House and the 37 Military Hospital area,” the statement from the police said.
According to the police, the protesters were arrested as a result of the “flagrant disregard of the court process served on the organisers, which seeks to prohibit them from embarking on a planned demonstration.”
The protesters are demanding a range of reforms, including a reduction in the cost of living, an end to corruption, and improved governance.
Speaking on the development on the Asaase Breakfast Show on Friday (22 September), Abban said the police did not err in arresting the #OccupyJubileeHouse protesters for unlawful assembly.
“….One school of thought says that as soon as you are served, you must stop, even though the injunction application has not been heard for the court to make orders,” the lawyer said.
“There is another school of thought which says there must be a clear order from the court, which prevents you from embarking on a cause of action. In both cases, depending on the circumstances of the case and the facts, they are all good laws.
“I think that depending on the case, just the mere filing of the application should be enough to injunct the other party, on the other hand the circumstances of the case or the fact may also dictate…,” Abban added.
