Nana Akua Owusu Afriyie, the New Patriotic Party’s (NPP) parliamentary candidate for the Ablekuma North Constituency in the 2024 election, has filed a suit at the High Court seeking to stop the Electoral Commission (EC) from re-running parliamentary elections in 19 polling stations.
Through her lawyer, Gary Nimako Marfo, Afriyie is asking the court to issue an order of certiorari to quash the EC’s decision, arguing that it violates an earlier High Court ruling issued on 4 January 2025.
That judgement had directed the EC to collate and declare the full results from all 281 polling stations in the constituency, not rerun any of them.
According to the application, the EC’s failure to complete the collation—having only processed 59 of the 62 outstanding polling stations—does not justify a partial re-run, especially in the absence of a new court order overturning the original directive.
“The EC acted in excess of jurisdiction,” the application argues, describing the decision as “arbitrary, capricious, unreasonable and wrongful”.
Background
The 4 January judgement, delivered by Justice Forson Baah Agyapong, followed a mandamus application by Afriyie. The court found that the EC had breached its duty by declaring the NDC’s Awurabena Aubynn the winner without collating all polling station results. Following that, the EC began collation on January 6 but left three polling stations unresolved due to disputes.
Then, on July 2, the EC announced a re-run in 19 polling stations, scheduled for July 11—a decision the NPP firmly rejects.
Reliefs Sought
Afriyie is seeking several legal remedies, including:

A declaration that the EC’s planned re-run is a violation of the January 4 judgement.

An injunction to stop the re-run.

An order compelling the EC to comply with the earlier court directive and finalise the collation process.
