NPP MP for Akwatia files motion to arrest contempt ruling against him
He argues through his lawyers that Justice Emmanuel Senyo Amedahe of the Koforidua High Court erred in allowing the Petitioner's lawyer to proceed with a contempt application despite a pending case at the Supreme Court. He claims this has led to a significant miscarriage of justice.

New Patriotic Party (NPP) Member of Parliament for Akwatia, Mr Ernest Kumi has filed a motion at the Koforidua High Court seeking to arrest the Contempt of Court ruling delivered against him by the High Court on Wednesday, 19 February 2025.
In a motion filed on Thursday, 20 February 2025, by his lawyer, Gary Nimako Marfo, and set for hearing on Wednesday, 26 February 2025, Akwatia MP Ernest Kumi argues that Justice Emmanuel Senyo Amedahe of the Koforidua High Court erred in allowing the Petitioner’s lawyer to proceed with a contempt application despite a pending case at the Supreme Court. He claims this has led to a significant miscarriage of justice.
“In the circumstances, this is a proper case where the ruling for the contempt application ought to be arrested pending the determination of the processes filed,” the affidavit in support of Mr Ernest Kumi’s motion to arrest the contempt ruling read.
Background
On 7 December 2024, Electoral Commission conducted parliamentary elections, with NPP’s Ernest Yaw Kumi winning the Akwatia Constituency seat against former NDC MP Henry Boakye-Yiadom.
However, before the results were gazetted, Boakye-Yiadom filed an election petition on 31 December 2024, at the Koforidua High Court, along with an ex-parte injunction restraining Kumi from acting as MP. Kumi only became aware of the injunction through WhatsApp service.
Kumi challenged the injunction on January 3, 2025, arguing that the petition was filed prematurely since the official gazette publication had not been made.
Despite this, the High Court dismissed his challenge on January 6, 2025, relying on an online news report instead of an official Gazette notification.
Dissatisfied, Kumi appealed the ruling at the Court of Appeal and also sought certiorari and prohibition from the Supreme Court to halt the case.
Despite being notified of the Supreme Court filings, Justice Emmanuel Senyo Amedahe proceeded to hear a contempt application filed by Boakye-Yiadom against Kumi for defying the injunction.
The contempt case was served via WhatsApp, and despite Kumi’s attempts to stay proceedings, the judge convicted him in absentia on 19 February ordering his arrest.
