The National Democratic Congress (NDC) parliamentary candidate for Kpandai in the 2024 general election, Daniel Nsala Wakpal, has filed an application at the Tamale high court seeking an order to commit the chair of the Electoral Commission, Jean Mensa, for contempt of court for what he says is her failure to carry out orders of the high court issued on 24 November 2025.
According to court processes filed by lawyers for Wakpal, the applicant alleges that although the EC chair was served with the court order on 25 November 2025, she has shown no sign of adhering to the said court order, dated the previous day (24 November).
“By the conduct of the respondent [the EC chairperson] it is clear that she has no intention to abide by the court’s order dated 24 November 2025,” says an affidavit deposed by counsel for Wakpal.
“I am advised by counsel and verily believe same to be true that the test for determining whether an action amounts to contempt is whether the act complained of interferes or tends to interfere with the due administration of justice.
“An act is deemed to be contemptuous when a person goes contrary to an order of a competent court of jurisdiction.
“The EC chair’s refusal to abide by the order of the court dated 24 November 2025 of which the same was served on her is contemptuous of this Honourable Court,” the affidavit accompanying the application says.
“In the circumstances, I pray that this obvious disregard of the EC chairperson of the orders of the court amounts to nothing more than contempt of which the [EC chairperson] ought to be convicted,” the affidavit further says.
Polling station “discrepancies”
On 24 November 2025 the Tamale high court ordered a fresh parliamentary election in Kpandai, instructing that the rerun be held within 30 days.
Justice Emmanuel Brew Plange handed down the ruling following a petition challenging the results of the 2024 parliamentary election in the constituency.
The case centred on alleged irregularities during voting and the collation of results, which were said to have compromised the integrity of the declared outcome.
The petition was filed by Daniel Nsala Wakpal, the MP in the eighth parliament and the NDC’s 2024 candidate for Kpandai, who disputed the victory of Matthew Nyindam, the candidate for the New Patriotic Party (NPP).
Wakpal argues that the election conducted on 7 December 2024 was invalid, highlighting discrepancies in Form 8A (Statement of Polls – Pink Sheet) for 41 out of 152 polling stations.
According to Wakpal, the election did not comply with Regulations 39 and 43 of the Public Elections Regulations 2020 (CI 127) and the lapses materially affected the results across the affected polling stations. He sought a court order to annul the results from those 41 polling stations and to direct a rerun for them.
Justice Plange agreed with Wakpal’s petition, nullifying the contested results and instructing the Electoral Commission to organise a fresh election to determine the legitimate winner.
