The National Democratic Congress (NDC) and Amenfi Central parliamentary candidate Joana Gyan Cudjoe have filed a motion at the High Court in Accra seeking an interlocutory injunction against the Electoral Commission (EC).
The motion, filed on Thursday (17 October 2024), requests the court to stop the EC from printing ballot papers and issuing a notice of poll for Amenfi Central in the upcoming 2024 parliamentary election.
The plaintiffs argue that the injunction is necessary to halt the election process in the constituency until the court resolves a substantive legal matter concerning the elections.
According to the document filed in court, the plaintiffs are asking the court to prevent the EC from taking further action until all legal issues are fully addressed.
The case will be heard on 24 October 2024.
The court’s decision on this matter could have a significant impact on the electoral process in Amenfi Central as the 2024 elections draw near.
Disqualification
Earlier, the Electoral Commission (EC) disqualified Joana Gyan Cudjoe, the National Democratic Congress (NDC) parliamentary candidate for Amenfi Central, from contesting in the 2024 parliamentary elections.
The EC’s decision is based on an order issued by the high court in Sekondi, which has imposed an injunction on her candidacy pending the final determination of an ongoing legal dispute.
The court’s interlocutory injunction, dated 31 May 2024, stems from a suit brought against Joana Gyan Cudjoe by Gyedu Frimpong and four others.
