
A lawyer in private practice, Tony Danquah, has written to the editor and management of GhanaWebbers for republishing an article he authored without crediting him with the publication.
Mr Danquah, in his letter, is essentially demanding that GhanaWebbers take immediate steps to remove the infringing article from their website and any other affiliated platforms of their news website.
He also wants GhanaWebbers to publicly acknowledge his authorship of the article and compensate him Twenty Thousand Ghana Cedis for the unauthorized use of his intellectual property.
“I authored a legal article titled “Remedies Under Ghanaian Company Law: Addressing the Gap for Aggrieved Directors, Shareholders, and Secretaries”, which article was first published on Friday, the 4th day of April, 2025.
“This article has since received widespread publication on reputable news portals, both local and international, including but not limited to Dennis Law News (dennislawnews.com), Asaase Radio (asaaseradio.com), Ghana News Agency (gna.org.gh), and Microsoft News (msn.com)- all of which duly attributed authorship to me as the original writer of the said article,” the lawyer’s letter read.
“However, it has come to my attention that your entity published the same article on your website, www.ghanaweb.live, on or about April 6, 2025, without my knowledge or consent and without attributing the work to me. Instead, you purportedly credited a source referred to as “Webbers Choice.”
“Your actions constitute a blatant and deliberate infringement of my rights under the Copyright Act, 2005 (Act 690), specifically section 42, which prohibits infringement of copyright by persons who, without the consent of the copyright holder, reproduce or publish the work as if it were their own,” Lawyer Tony Danquah’s letter further read.
“In view of the above, I hereby demand that you comply with the following forthwith: Immediate removal of the infringing article from your website and any other affiliated platforms; Public acknowledgment of my authorship of the said article and payment of compensation in the sum of Twenty Thousand Ghana Cedis (GHc 20,000.00) for the unauthorised use of my intellectual property.
“Please be advised that failure to comply with the above demands within seven (7) days of your receipt of this letter shall leave me with no other alternative than to take legal action against your entity and all responsible persons for the infringement of my intellectual property rights.
I will also seek “an order restraining your entity from continuing with the said breach, damages for breach, and costs, including solicitor’s costs, without further notice. This notice is issued without prejudice to any other legal remedies available to me, all of which are hereby expressly reserved,” lawyer Tony Danquah’s letter concluded.
