Kissi Agyebeng: You’ll feel me from October

The Special Prosecutor says he is going to roll out cases on his desk from the month of October onwards, after using the past two months to set up his office

Kissi Agyebeng, the Special Prosecutor, has served notice that he is going to hit the ground running starting tomorrow, 1 October 2021.

He said he will roll out cases on his desk from the month of October onwards, after using the past two months to set up his office.

“I’m reviewing every single case before me since August … I’ve reviewed all the cases and, from October, we are going to start rolling them out,” Agyebeng told the Accra-based Peace FM on Thursday (30 September).

Election rigging

Agyebeng also warned electoral officers that he would prosecute them if they tamper with election results or rig elections in favour of any particular political party or candidate.

“If you are an electoral officer or a returning officer and you change results I am going after you … Immediately you declare the results I am going after it and matching polling stations, and matching pink sheets with pink sheets, and if they don’t tally I am going after you,” he said earlier on Starr FM.

He added that probing electoral rigging falls under the jurisdiction of the Office of the Special Prosecutor and that he need not wait for the Supreme Court before he probes any electoral-related rigging.

OSP’s mandate

Act 959, which establishes the Office of the Special Prosecutor, spells out three main objectives of the office.

These are: to investigate and prosecute alleged corruption or suspected corruption and corruption-related offences; to recover the proceeds of corruption and corruption-related offences; and to take steps to prevent corruption.

Functions of the OSP

The functions entrusted to the Office are:

(a) the investigation and prosecution of cases of alleged or suspected corruption and corruption-related offences under the Public Procurement Act 2003 (Act 663);

(b) the investigation and prosecution of cases of alleged corruption and corruption-related offences under the Criminal Offences Act 1960 (Act 29) involving public officers, politically exposed persons and persons in the private sector involved in the commission of the offence;

(c) investigation and prosecution of cases of alleged or suspected corruption and corruption-related offences involving public officers, politically exposed persons and persons in the private sector involved in the commission of the offence under any other relevant law;

(d) recover and manage the proceeds of corruption;

(e) disseminate information gathered in the course of investigation to competent authorities and other persons the Office considers appropriate in connection with the offences specified in paragraphs (a) and (b);

(f) co-operate and coordinate with competent authorities and other relevant local and international agencies in furtherance of the act; and

(g) receive and investigate complaints from a person on a matter that involves or may involve corruption and corruption-related offences.
