Justice Paul Baffoe-Bonnie, the most senior member of Ghana’s Supreme Court, will be Acting Chief Justice following the suspension of Justice Gertrude Sackey Torkornoo.
His appointment is in line with Article 144(6) of the 1992 Constitution, which mandates that the most senior judge of the Supreme Court assumes the role of Chief Justice when the position becomes vacant or the incumbent is unable to carry out their duties.
Justice Baffoe-Bonnie, who joined the Supreme Court bench in June 2008 under President John Agyekum Kufuor’s administration, now assumes interim leadership of the judiciary amid an ongoing investigation into petitions filed against the suspended Chief Justice.
Probe
President John Mahama has suspended Chief Justice Gertrude Torkornoo following the formation of a committee to investigate multiple petitions lodged against her.
A statement from the Presidency on Tuesday (22 April) said the move was taken in accordance with Article 146(6) of the country’s Constitution, which permits the President to act once a prima facie case has been established and after consultation with the Council of State.
The committee, tasked with conducting the inquiry, includes two Supreme Court judges, a former Auditor-General, a senior military officer and a university professor:
- Justice Gabriel Scott Pwamang – Supreme Court
- Justice Samuel Kwame Adibu-Asiedu – Supreme Court
- Daniel Yaw Domelevo – Former Auditor-General
- Major Flora Bazwaanura Dalugo – Ghana Armed Forces
- Professor James Sefah Dzisah – University of Ghana
According to the statement, President Mahama has determined there are sufficient grounds to warrant a formal investigation.
In line with Article 146(10) of the Constitution and on the advice of the Council of State, the President has issued a warrant suspending the Chief Justice from her duties with immediate effect, pending the outcome of the committee’s work.
No further details of the allegations have been made public at this time.
