Election 2024: Supreme Court dismisses Bernard Mornah’s application challenging his disqualification

A five-member Supreme Court panel presided over by Justice Tanko Amadu has dismissed an application by Bernard Mornah, the presidential candidate of the Peoples National Convention (PNC), seeking to quash the High Court’s judgment upholding the Electoral Commission’s (EC) decision to disqualify Mr Mornah from contesting the 2024 presidential elections.

The Supreme Court at an emergency sitting today, Friday, 22 November 2024 first heard the parties in the case at about 9:30 am.

The court stood down the case till 11:am to allow lawyers of the EC to file their affidavit in opposition to the application by Bernard Mornah.

When the Court reconstituted at 11:00 am, It heard the oral presentation of the parties and rose again to prepare its decision.

At about noon, the Court resumed sitting and delivered its unanimous decision dismissing the application by Bernard Mornah. Essentially, the Supreme Court held that the High Court decision that upheld the decision of the EC was grounded in sound law.

Bernard Mornah was represented in Court by Lawyer Harold Atuguba and the Electoral Commission on the other hand was represented by Lawyer Justin Amenuvor. The Court did not award cost to the the respondent (EC) since it was a constitutional matter.
