I am not accountable to you – Domelevo replies Audit Service board chair

Domelevo has questioned why the Audit Service chair still holds himself as the board chairman after the expiration of the board’s term of office on 11 October.

Daniel Yaw Domelevo, the on-leave auditor-general has stated that he does not owe the Audit Service outstanding arrears for any imprest he took for his travels as the auditor-general.

His comment is in response to a letter addressed to him by the chairman of the Audit Service demanding for the refund of outstanding monies due the Audit Service after his (Domelovo) trip to The Hague and London whiles in office.

In a statement, Domelevo said “I refer to your letter with reference ASB/01/01/VOL 1/15 dated 30 November 2020 on the above subject and will like to remind you that the question as to whether or not the audit is even legal, is before the supreme court for determination and for which reason your request is clearly contemptuous of the court per writ number J1/2/2021 titled Daniel Yaw Domelovo v Prof Edward Dua Agyeman and two others”

The on-leave auditor-general has since questioned the capacity of the Audit Service chairman, Prof Edward Dua Agyeman arguing that his tenure in that capacity has expired.

“Read section 2(3) and 7 of the Public Financial Management Act 2016 and you will realise that a mandate you and the board purport to have under the Audit Service Regulations 2011(CI70) is that of the principal spending officer – hence I am not accountable to you. That said not even a pesewa is outstanding against me for any advance or imprest I took for any of my travels.”

Domelevo letter to Audit Service

Domelevo is also challenging the Audit Service chair to provide evidence of his reappointment as board chair of the audit service in order to be accorded the necessary respect.

“I also wonder why you will hold yourself as the board chairman after the expiration of the board’s term of office on 11 October 2020 contrary to section 5 of the Audit Service Act 2000(Act 584). Until you provide evidence of your reappointment in accordance with article 189(1) and section 5(1) of Act 584, I deem you to be acting ultra vires and will treat you as such.”

President Akufo-Addo on 29 June 2020 directed Daniel Domelevo to proceed on his accumulated leave of 123 days.

A statement from the Communication Directorate of the Jubilee House further directed Domelovo to hand over all matters relating his office to his Deputy Johnson Akuamoah Asiedu.
