Anti-LGBTQ+ Bill: Supreme Court grants Richard Sky’s request to file new motion

A five-member panel of the apex court, presided over by Justice Gertrude Torkornoo, also gave lawyers of the Speaker of Parliament and the Attorney General up to 17 May, to file their processes

The Supreme Court has directed lawyers of the man seeking to stop President Nana Addo Dankwa Akufo-Addo from assenting into law the Human and Sexual Rights and Family Values Bill commonly referred to as the anti-gay bill, to file a fresh motion paper for an interlocutory injunction with supporting affidavit and statement of case to the substantive suit.

A five-member panel of the apex court, presided over by Justice Gertrude Torkornoo, also gave lawyers of the Speaker of Parliament and the Attorney General up to 17 May, to file their processes.

When the case, which was filed by broadcaster, Richard Sky, was called today (May 8), the business of the day was to deal with fundamental issues standing in the way of the substantive case.

Lawyers for the plaintiff, led by Paa Kwesi Abaidoo, sought leave of the court to leave to file supplementary affidavit in support of their injunction, and to amend their reliefs.

Counsel for the Speaker of Parliament, Thaddeus Sory, raised a preliminary legal objection to the motion on grounds that his affidavit in opposition to the interlocutory application objected to the formation of plaintiff’s relief.

He added that allowing them to amend it would defeat his objection.

“He (Plaintiff) cannot avoid the consequences of that objection by filing a motion for leave to amend those reliefs and render my objection redundant,” he said,

The court dismissed the preliminary objection saying it was unnecessary and does not seek to help the court in any way.
