The Supreme Court has granted an application by 14 civil society organisations (CSOs) to join a constitutional case challenging the legality of the country’s anti-corruption agency, the Office of the Special Prosecutor.
A seven-member panel presided over by Chief Justice Paul Baffoe-Bonnie admitted the application after lawyers for the organisations argued that their expertise would assist the court in resolving the matter.
Counsel for the applicants, Kizito Beyuo, told the court that the CSOs possess extensive institutional knowledge in governance, accountability and anti-corruption work, making their participation necessary in a case with far-reaching implications.
The organisations include Ghana Centre for Democratic Development, Transparency International Ghana, IMANI Africa, Ghana Anti-Corruption Coalition, and several others active in policy advocacy and governance reforms.
The substantive case, Adamtey v Attorney-General, was filed by a private citizen challenging the constitutionality of the Office of the Special Prosecutor, established under the Office of the Special Prosecutor Act, 2017 (Act 959).
The plaintiff is questioning whether aspects of the agency’s establishment and operational structure comply with Ghana’s 1992 Constitution.
The Office of the Special Prosecutor was created as an independent body to investigate and prosecute corruption-related offences, particularly those involving public officials and politically exposed persons.
Since its establishment, it has handled several high-profile cases and remains a central institution in Ghana’s anti-corruption framework.
The Supreme Court’s decision to admit the CSOs is expected to broaden the scope of the case, introducing additional public interest and policy perspectives into proceedings that could significantly affect the future mandate and operations of the anti-corruption body.
The case has drawn considerable public attention due to its potential implications for accountability mechanisms and institutional independence in Ghana.
