Duffuor withdrew writ against NDC because it was defective, say sources

Dr Kwabena Duffuor, a candidate for the Election 2024 presidential nomination of the National Democratic Congress (NDC), has withdrawn the court action he filed against the general secretary of the NDC and four others.

His lawyer, Opoku Amponsah, withdrew the suit on his behalf in court today (Friday 12 May 2023) when the case was called for hearing.

Misfiled?

Asaase News sources familiar with the decision by the Duffuor campaign team have hinted that lawyers withdrew the matter before Justice Mariama Affoh’s court was because the writ was defective.

The sources say the writ should have been filed against the National Democratic Congress as a party and not the general secretary, who is merely an officer of the NDC.

It is not clear whether the Duffuor campaign team will file another writ seeking to injunct the NDC’s 13 May presidential and parliamentary primaries before the close of day today.

This would prevent the party from going ahead with the polls as planned.

Speaking to reporters in the foyer of the law court complex after the court sitting in Accra on Friday (12 May), the general secretary of the NDC, Fifi Kwetey, said he is confident that the party’s primaries will take place as scheduled.

Kwetey said that given the withdrawal of the writ, there are no longer any impediments in the way of Ghana’s largest opposition party holding the internal elections, a crucial precursor of the nex general election, scheduled for 7 December 2024.
