Essikado-Ketan: Court dismisses application to strike out election petition

The court ruled that the application by Frank Davies, counsel for the first respondent to strike out the petition was without merit

A Sekondi High Court has dismissed an application filed by Frank Davies counsel for the first respondent, to strike out an election petition filed by Prof. Dr Grace Ayensu-Danquah, the NDC parliamentary candidate in the 7 December elections.

The suit is challenging the declaration of Joe Ghartey, the first respondent as winner of the 7 December 2020 parliamentary election in Essikado-Ketan.

Counsel for Ghartey had prayed the court at an earlier sitting on 16 March 2021, to strike out the petition on the grounds that the petition ought to have been signed by the petitioner, Prof. Dr Grace Ayensu-Danquah herself and not her counsel, David Kwadzo Ametefe.

The court, presided over by Dr Richmond Osei Hwere, after legal references and interpretations, on Tuesday (23 March), ruled that the application by the first respondent to strike out the petition was without merit.

The court, however, awarded a cost of GHC4,000 against the counsel for the first respondent.

In his ruling, Dr Richmond Osei Hwere said, “lawyers act as client’s agent litigation in which case, they can sign on behalf of their clients.”

He said the parliamentary election petition is a writ in a different form that can be signed by a lawyer.
