Manhyia South MP, Lawyer Nana Agyei Baffour Awuah, has expressed strong reservations over the Attorney-General’s decision to withdraw high-profile corruption cases, questioning the impact on justice and accountability.
Speaking on The Forum on Asaase Radio on Saturday (8 February), the New Patriotic Party (NPP) lawmaker said that as both Attorney-General and Minister of Justice, the AG has a duty to ensure fairness and transparency in legal matters affecting Ghanaians.
“If you are the AG, you are also a Minister of Justice, making sure you look after the well-being of all Ghanaians. An injustice should worry you. Even if you want to discontinue a case because there’s no merit to it, you owe the greater Ghanaian public an explanation, particularly when you consider the facts of the case, the interest surrounding it, and the consequences of the alleged actions of the accused,” Awuah stated.
He cited the appointment of the new Bank of Ghana Governor, who previously had two pending criminal cases related to the banking sector cleanup, highlighting concerns about political bias in the Attorney-General’s actions
“You withdraw the charges and the next day he is made the governor. What country are we building? At the very least, explain to Ghanaians that the charges were wrong. You don’t just withdraw and say nothing.
“Are we saying that going forward, any member of a political party is now immune to prosecution? Is that what we want to reduce Ghana into—where I willfully cause financial loss, and just because my party is in power, I go unpunished? This is an affront to the rule of law,” he observed.
He further criticized the NDC government’s anti-corruption stance, pointing out that President Mahama ran on a platform of fighting corruption but has failed to hold his own party members accountable.
“The NDC campaigned on fighting corruption and even set up the ORAL. But if you can’t prosecute members of your own party, who else will you prosecute? Do you want Ghanaians to see you as a partisan AG who only goes after non-members of the party?” he quizzed.
Despite his concerns, Awuah said he does not advocate for constitutional reform, arguing that the current framework is adequate if leaders act with integrity.
“The framers of the Constitution thought they were making laws for reasonable people to work with. The problem is not the Constitution—it’s that we are not speaking truth to power,” he stated.
