It’s “plausible” Israel has committed acts that violates Genocide Convention, World Court rules

The International Court of Justice(ICJ) has found that there is sufficient basis for South Africa's  Request for the indication of provisional measures concerning the Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip( South Africa v. Israel).

President of the court, Joan Donoghue, revealed the majority of the court has ruled 15-2 in favour of the motion.

The World Court found it is “plausible” that Israel has committed acts that violate the Genocide Convention.

Judge Donoghue states, “By 15 votes to 2, the state of Israel shall ensure, with immediate effect, that its military does not commit any acts described in point one above,” referring to stopping military action.

The two judges that ruled against are Judge Jula Sebutinde from Uganda and Judge Aharon Barak, former president of the Supreme Court of Israel.

How it started

South Africa submitted the Application Instituting Proceedings last year on the 29 December 2023, to highlight the genocidal acts that they believed Israel was committing in the Gaza Strip, particularly from 7 October, 2023.

The hearings of South Africa‘s ICJ genocide case against Israel took place on the 11 and 12 January, during which both countries presented their oral presentations to the court.

Many countries around the world have shared the same sentiments as South Africa and have backed the country’s genocide case against Israel at the ICJ.

These countries include Bolivia, Belgium, Brazil, Maldives, Venezuela, Namibia, Afghanistan, Albania, Azerbaijan, Bahrain, Bangladesh, Benin, the United Arab Emirates (UAE), Brunei Darussalam, Burkina Faso, Algeria, Djibouti, Colombia, Chad, Indonesia, Morocco, Cote d’Ivoire, Palestine, Gabon, Gambia, Guinea, Guinea Bissau, Guyana, Iraq, Iran, Cameroon, Qatar, Kazakhstan, Kyrgyzstan, Comoros, Kuwait, Libya, Lebanon, Malaysia, Mali, Egypt, Mauritania, Mozambique, Niger, Nigeria, Uzbekistan, Pakistan, Senegal, Spain, Sierra Leone, Somalia, Sudan, Surinam, Syria, Saudi Arabia, Tajikistan, Togo, Tunisia, Türkiye, Turkmenistan, Uganda, Oman, Jordan, and Yemen.

Countries like the United States and the United Kingdom have openly denied claims of genocide and have given their full support to Israel.

Recently, the United Nations General Assembly requested an advisory opinion from the ICJ on Israeli practices affecting the human rights of the Palestinian people.

Countries like Indonesia will gain insights from experts to share with the court.
