Asiedu Nketiah was the star witness of petitioner, says Supreme Court

The Supreme Court on Thursday (4 March) described Johnson Asiedu Nketsiah as the star witness of the petitioner in the 2020 election petition.

Delivering the final ruling on the petition, Chief Justice Anin Yeboah said Asiedu Nketiah’s testimony appeared to have some relevance to the issues at stake.

“Out of these three witnesses, the one whose testimony appears to have some relevance to the issues at stake was Johnson Asiedu Nketiah (PW1). He was, in fact, the star witness for the petitioner. His testimony vividly explains the reasons why the petitioner is in court.

“As for the other witnesses, that is PW2 and PW3, Dr Kpessa-Whyte and Robert Joseph Mettle-Nunoo the little said about their testimonies relative to the issue at stake the better.”

Fanciful tale

“They recounted a fanciful tale of how the chairperson refused to heed their complaints on some irregularities they noticed in some of the collation forms that came from some of the regions.”

Chief Justice Anin Yeboah added, “We describe this evidence as fanciful because despite this alleged protest they went ahead to verify and testify 13 out of the 16 regional collation sheets. Their testimony included an account of how the chairperson of the first respondent trick them to leave the strongroom by sending them on an errand to confer with the petitioner during which period she declared the presidential election without their participation…”

Mahama’s claims

John Mahama, the petitioner had claimed that none of the candidates who contested the polls obtained more than 50% of the votes cast.

Mahama alleged that the second respondent, President Akufo-Addo won the election through vote padding.

He also claimed the candidate benefitted from arithmetic and computational errors. He concludes that the EC’s declaration of President Akufo-Addo is unconstitutional since he did not obtain more than 50% of the votes cast.
