A nine-member Supreme Court panel presided over by Chief Justice Gertrude Torkornoo, has dismissed an injunction application seeking to stop the Speaker of Parliament, Alban Bagbin, from proceeding with the passage of the “Promotion of Proper Human Sexual Rights and Ghanaian Family Values Bill, 2021”.
The application for interlocutory injunction as well as the substantive application for contempt of court was filed by an academic researcher, Dr Amanda Odoi.
The Supreme Court essentially held that they have considered the merits of the case and are of the considered view that a prima facie case has not been made to convince the court to injunct the work of Parliament neither have they (the Court) been convinced to injunct an uncompleted work of Parliament.
“The issues raised by this application for injunction are matters to be determined by the substantive matter. This application for injunction is dismissed, ” the Supreme Court ruled.
Following the decision of the Supreme Court not to granted the interlocutory injunction against the Speaker, lead lawyer for the Applicant, Dr Ernest Ako, told the Court that his client wishes to withdraw the application for contempt in its entirety.
The Supreme Court, after the withdrawal, went ahead to strike out the application seeking to commit the Speaker of Parliament for contempt, as withdrawn.
