
The Office of the Attorney General says it considers the decision by the Court of Appeal in the matter of the high court case of the Republic vs Cassiel Ato Forson and two others (the “Ambulance Case”) “grossly unfair to the nation and inimical to the fight against impunity and abuse in public office”.
A statement issued by the AG’s Office on Tuesday (30 July) said it “will promptly file an appeal in order to erase the effect of this erroneous decision of the Court of Appeal”.
The Court of Appeal on Tuesday (30 July) upheld an appeal by the Minority Leader and former deputy finance minister, Cassiel Ato Forson, against a high court decision allowing the case in which he is the main defendant to continue to run.
The latest decision by the Court of Appeal overturns a previous order by the high court last year, which required Forson to open his defence in the ambulance trial after the Attorney General’s Office established a prima facie case.
The Court of Appeal in its decision on Tuesday said that the high court’s decision should be set aside because “the prosecution failed to establish sufficient evidence. The trial judge erred in calling on A1 [Cassiel Ato Forson] to open his defence.”
